  1. Eligibility: NO PURCHASE NECESSARY. The Exide Ultimate NASCAR Fan Sweepstakes (“Sweepstakes”) is open to legal U.S. residents, 18 years or older. Employees of Exide Technologies (“Exide”), NASCAR, Inc., MagicDust Television, LLC, participating retailers, their affiliates, subsidiaries, advertising and promotion agencies and the immediate families (spouses and parents, siblings and children and each of their spouses) and persons living in the same households of each of the above are ineligible. VOID WHERE PROHIBITED BY LAW. Exide Technologies, 13000 Deerfield Pkwy., Bldg. 200, Alpharetta, GA 30004 is the sponsor of this promotion. NASCAR, Inc. and MagicDust Television, LLC are not sponsors of this promotion. NASCAR, Inc. has no liabilities or obligations in connection with this promotion.
  2. How to Enter: The Sweepstakes begins on or about November 24, 2008 and ends on December 28, 2008 (the “Promotion Period”). By entering this Sweepstakes, entrants agree to be bound by these Official Rules, the rules and conditions found on the Entry Form and the decisions of Exide, which are final and binding in all respects. Limit one (1) entry per person. If multiple entries are received from the same person, only the first entry may be considered and all subsequent entries may be disqualified. To enter, complete the online Exide Ultimate NASCAR Fan Sweepstakes Official Entry Form found at www.exideultimatefangift.com or include your name, address, city, state, zip code, telephone number, email address and make/model/year of vehicle on a 3x5 card and mail to: Exide Sweepstakes, 4747 E. Elliot Rd. #29-511, Phoenix, AZ 85044. Entries must be postmarked by December 29, 2008 and received by January 2, 2009. No mechanically reproduced, illegible, incomplete or forged entries will be accepted. Neither Exide nor NASCAR is responsible for lost, late, illegible, misdirected, damaged, incomplete, or postage-due entries.
  3. Drawing: On or about January 5, 2009, a random drawing will be conducted from all online and mail-in entries by Mighty Interactive (marketing agency). The odds of winning depend on the number of entries received.
  4. Prizes: There is one (1) Grand Prize consisting of a ticket package for two (2) people (18 years or older) to NASCAR Sanctioned races of the sponsor’s choice;; a VIP tour; roundtrip airfare, hotel accommodations and rental car, with an estimated value of approximately $6,900 for this complete package. All unspecified travel-related expenses, including but not limited to meals, gratuities and incidental hotel expenses, are the sole responsibility of the winner. Winner must be able to attend on dates specified or prize will be forfeited. All standard NASCAR® and racetrack terms and conditions apply to tickets and VIP tour. Award of the Grand Prize is subject to NASCAR, track promoter’s and Exide’s standard releases and waivers, which winner and guest must sign in order to receive the prize. If race is delayed, postponed or cancelled for any reason, winner will not receive cash or other substitution for tickets, but tickets may be subject to standard rain check policies and procedures established by issuer. Seat locations are at Exide’s discretion. In case of unavailability of any prize, Exide reserves the right to substitute a prize of equal or greater value. There are also Instant baseball cap winners to be awarded to five (5) winners per day during the Sweepstakes, through a random drawing conducted from all online and mail-in entries by Mighty Interactive. The total estimated value of these baseball caps is approximately $2,000. All taxes on all prizes awarded are solely the responsibility of the winner.
  5. Notification of Winners/Claiming Prizes: The Grand Prize winner will be notified by mail and will be required to sign and return an Affidavit of Eligibility and Liability Release, and where legal, a Publicity Release, within 14 days of the first notification attempt. If the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner will be selected through the same random drawing procedure. Instant Prize winners will receive their prize by mail. Neither NASCAR nor Exide shall have any liability for any winner notification or prize that is lost, intercepted or not received by the potential winner for any reason. If any potential winner is found to have not complied with these Official Rules, such person will be disqualified and an alternate winner will be selected.
  6. Additional Terms: Exide reserves the right in its sole discretion to disqualify any individual who is found to be acting in violation of these Official Rules, or to be acting with the intent to disrupt or undermine the legitimate operation of the Sweepstakes. In the event that any provision of these Official Rules or of the rules and conditions of the Entry Form is determined to be invalid or otherwise unenforceable or illegal, the rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were modified so as to be in compliance with the applicable state, local or other legal requirement. Official Rules also located at www.exideultimatefangift.com ALL ISSUES CONCERNING THESE RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE SWEEPSTAKES SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF GEORGIA WITHOUT GIVING EFFECT TO ANY CONFLICT OF LAW RULES. EACH SWEEPSTAKES ENTRANT AGREES THAT THE COURTS LOCATED IN ATLANTA, GEORGIA SHALL HAVE EXCLUSIVE JURISDICTION OVER ANY PROCEEDING ARISING OUT OF OR BASED UPON THE SWEEPSTAKES OR THESE RULES, AND BY PARTICIPATING IN THIS SWEEPSTAKES, EACH ENTRANT AGREES TO WAIVE ANY CLAIM THAT HE/SHE IS NOT SUBJECT PERSONALLY TO THE JURISDICTION OF SAID COURTS OR THAT ANY SUCH SUIT OR OTHER PROCEEDING IS BROUGHT IN AN INCONVENIENT FORUM OR IMPROPER VENUE. Neither Exide nor NASCAR shall be liable for any suspension or termination of the Sweepstakes due to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, or any cause not reasonably within Exide’s control, and in the event the Sweepstakes is terminated as a result of any such event, the Prize winners will not be entitled to substitute prize(s) or monetary entitlement, except as provided by applicable law.
  7. Release: By participating, entrants and the Grand Prize winner agree to release Exide, NASCAR, Inc., their parent companies, affiliates, subsidiaries and agents, including without limitation its advertising and promotion agencies, and each of their respective directors, employees and officers (collectively "Released Parties"), from any and all liability arising from or in connection with participation in this promotion, or the awarding, receipt or use of any prize. Trip winner accepts the inherently dangerous nature and risk in attending NASCAR® sanctioned events, including personal injury and/or death, acknowledges that his/her participation in the prize event is voluntary, acknowledges that there are natural factors and occurrences which may impact on or affect the safety of the activities he/she is participating in and he/she assumes the risk of such factors and occurrences and agrees that the Released Parties shall not be in any way responsible for any resulting injury and/or death.
  8. Winners’ List: Winners list will be posted on www.exideultimatefangift.com or may be obtained by sending a self-addressed stamped envelope to Exide Sweepstakes, 4747 E. Elliot Rd., #29-511, Phoenix, AZ 85044. All such requests must be received by January 16, 2009, unless longer period is required by applicable law. Vermont residents may omit return postage.
